Lawsuit against Kel Tec (KSG) & Pro Mag
« on: August 15, 2014, 10:23:03 pm »
It appears that some guy in VA shot most of his support hand off because he cheaped out with a crappy vertical grip and shucking the action with gorilla strength.  Apparently the vertical grip slid off the rail and because the KSG is a bullpup and only 26" it was very easy for his hand to go in front of the muzzle and blast his own hand into pink mist.  IMO this lawsuit is going against 2 companies because this guy is pretty short on brains and wants someone else to pay for his stupidity & carelessness.  This is bad news for Kel Tec as they are having enough supply problems and this will do nothing but drain resources that are better served putting into employees, machines & materials to put out more product.

I really don't think it's KT's fault for the guy using crappy accessories.

No but they might find that it's KelTec's fault for putting an accessory rail on the pump, and a crappy one at that. It's no secret that the rail on that gun is prone to break off, especially with a VFG.

Quite honestly, is it the accessory manufacturer's, either?  Most companies have on their packaging, that little disclaimer: Company XYZ is not reponsible for injury or death caused by the use of this product, blah, blah blah... :shrug

But I don't think that is what happened here...  The vfg's little plastic 'nib' that fits up between the rail slots sheared off.  And the KSG did not have a 'stop' to prevent the vfg from sliding foward and off.  That is the basis of the complaint against each company.

On my KSG the only thing that I have on my pump is some Magpul rail covers

Printing that you are not responsible on your product doesn't actually count for much regarding legal responsibility.

I think KelTec is [probably in a good position to fend off this lawsuit with minimal (relative) legal expense.  The vertical foregrip maker...not so much.

Unfortunately in our country we can sue pretty much anybody for anything and until the judge says "dismissed" then all you can pretty much do is wait until your day comes up in court.
