So, does that count as an SBS or an SBR?

SBS, I think. It also appears to be full-auto, so it's already NFA.

I believe machine guns are exempt from barrel length restrictions/requirements.

It looks like it is a removable upper, so the NFA bit would be the lower. Wouldn't you need a form for the upper, for being short barreled, and the lower, for being full auto? Or does it not need an SBR or SBS form if you are getting it for a FA lower? It seems odd to do that, and it also would cut the ATF's profits, which is why I assume you would have to pay the tax for each part.

There are already all sorts of short barreled AR uppers on the market. You can order them and have them sent straight to your house - almost totally unregulated. You can put them on a pistol lower and be okay, and you can put them on a registered full auto lower and be okay. They only become an NFA concern when you mate them with a rifle lower and thereby make an SBR.

This might be different from a regular upper because it is a smoothbore and has a bore over .5".

It couldn't go on a pistol lower without being a short barreled shotgun, and even without the barrel length issue it's likely to fail to get the usual "sporting purposes" exemption and be classed as a destructive device for having an over half inch bore.

It's hard to say what the BATF will actually do, as they tend to lack much consistency.

If it was a pistol lower, wouldn't it be an AOW, since it doesn't have a stock? Jesus... maybe we should send a picture of that to Carolyn McCarthy and Sarah Brady. Might give them heart attacks.

Good to know about the short uppers, I hadn't ever thought of the pistols.

It would be nice if you could get something like a Socom 16 flash hider for a shotgun, that would help with the recoil, and if you had a big enough one, you could make up for the short barrel. Only issue would be expansion after leaving the barrel, you might need to take a cue from the people over in the UK that make shotgun suppressors for how to do that without tearing up the flash hider.
