They are, however, still using the term "murder" in reference to what was clearly self-defense.

A man who shot dead an intruder at his Kent home, days after receiving threats, has been cleared of murder.

Kenneth Batchelor, 51, Canterbury Road, Chilham, walked free from Maidstone Crown Court after a week-long trial.

He had admitted accidentally shooting Matthew Clements, 42, in November 2007 who appeared at an open window after climbing up scaffolding.

The court heard Mr Clements, of Ashford, was a 20-stone, 6ft-tall "bully" with an "explosive temper".

Following the verdict, Judge Jeremy Carey said: "No-one should draw any conclusions of a general kind on this case."

He said it was a "most unusual case".

Nothings changed - there were severe extenuating circumstances, and they still prosecuted Mr. Batchelor.

Clemens had a rap sheet a mile long, including for threatening a garage manager with an UZI.

You'll note he was still out and about.

His history and the fact that he was armed on the night, with the express intention of "teaching [Batchelor] a lesson" is likely the only reason Batchelor got off.

Sometimes I hate this country.  At the same time, he did get off... maybe there's hope yet.
