Title: ATF Status
Post by: StevenTing on January 02, 2015, 04:09:43 pm
Is it worth it to call the ATF to find out the status on paperwork?  My thought is that it's not going to get me the silencer any faster and just take up someone's time.

No, it does no good. I just rang off the phone w/my friend who is a Class 3 Dealer. He said the median turn-around time for nearly all BATFE paperwork (specifically suppressors) is right now averaging 5 months. He told me to tell you to just sit tight and wait it out...quietly. The BATFE, like DMV, hate pests and can "slow walk" a "nuisance customer".

5 months is what I'm hearing too.  But it's trending down toward 4 months.  Based on the 4 month time frame, I should be out of NFA jail by end of this month.  5 month time frame means in time for my Birthday in Feb.

I spoke with an ATF agent the other day, and they said it's taking about 9 months.

I live in Utah. It took just under 7 months to get my can from the time I mailed the paperwork in. I got it about a month and a half ago.

Hard to believe that it's back up to 9 months right now.  Friends that turned their apps back in July have already received their stamp.

When did you submit your app?

Oh, I was wrong. Just under 8 months. Mailed early March, received early November.

Back in March the average seemed to be about 7months according to NFATracker.com.

But I think we've all come to the same conclusion that it doesn't really matter to call on the status.

I did mine on a trust. Turnaround was four months. I don't know why, but the form 4 for nfa trusts seem to come back quick.

Because that's a different process handled by a different office, from what I was told by an ATF agent.
Hmmm.  I know we have a couple ATF Agents that are members here... I wish they would chime in with some insight.
I looked at my notes from the meeting with ATF, and I stand corrected - my note says "8 to 9 Months".

We are seeing form 4s turn around in 4-5 months right now.

Based on this, I should have mine somewhere between End of Jan to End of Feb.  End of Feb would be 5 Months on my Birthday.

Submitted Form 4 with NFA Trust September 24th
paperwork came back Feb 9th for me to pickup.

Fits in that 4-5 month range, but it sure seems a lot longer when you are waiting..

That's not true. All the NFA stuff goes through the same process, same office, same examiners. All my trust-held forms have the same signature as my non-trust friends' forms. The examiners are assigned geographically.

This is off-topic, but is a question of 'ATF status:'

My (formerly Sanguine's) Beretta Cx4 has been converted to an SBR by DNA Guns.  They are waiting on the 'acknowledgement of manufacture' from the ATF, before they can start the Form 3 to transfer to my local dealer.  It is my understanding that they have been waiting on this letter for roughly two months...  Is this a normal wait time?

Isn't this a Form 1?  Usually those are about a month.

As I understand the process for an 07/02 FFL/SOT manufacturing an NFA device, the only thing they need to do is to send in a Form 2. The instructions say:

Quote
4.
Submission
     a.    The manufacturer shall file a separate notice for firearms manufactured or firearms reactivated during a single
day by the close of the next business day.
     b.    The importer shall file a separate notice for each permit on which firearms are imported during a single day no
later than 15 days from the date the firearm was released from Customs custody.
     c.    The notices shall be filed with the National Firearms Act Branch, Bureau of ATF, 244 Needy  Road, Martinsburg,
WV 25405
5.
Submission by Facsimile Transmission.
Form 2 may also be submitted for approval via facsimile transmission
( (304) 616-4501) provided that the licensee has filed an affidavit with the NFA Branch in accordance with ATF
       Industry Circular 89-6.
6.
Receipt by NFA Branch.
Receipt of the notice by the NFA Branch will effectuate the registration of the firearms.
7.
Status Inquiries and Questions.
The NFA Branch telephone number is (202) 927-8330. Any inquiry relating to the
status of a notice to register an NFA firearm or about procedures in general should be directed to the NFA. Please be
aware that the information relating to the registration of firearms is defined as “return” or “return information” by 26
U.S.C. § 6103 and disclosure is generally prohibited to anyone other than the registrant. Information relating to the
NFA and other firearms laws is also available at the ATF Internet website at
www.atf.gov
.

I don't see any reason they'd need a written acknowledgement to go ahead with the transfer to you.

Of course I could be way out in left field.

They are waiting on the Form 2.  While they may not technically have to...  This is the ATF...  I will not whine about anyone's efforts to remain in an abundance of compliance.  Even if it costs me an additional two months of wait.
