This guidance is from a memo my NFA lawyer gave me.  If I read the memo correctly, apparently some people have gotten in trouble in the past by the dealer incorrectly transferring an NFA item to the person instead of to the trust.  Part of the confusion seems to have been because the trust was buying an item that was paid for by a personal check from the individual trustee.  I agree it sounds weird, but just because you and I know how to do it properly doesn't mean other people haven't messed it up before.  If I understand this memo, anyway.  If the trust was buying the item then the item should have been transferred to the trust.  Seems like that doesn't always happen correctly.  But, if the item is incorrectly transferred, then it's illegal and can never be made legal again.   >:(

If you're paid up with your lawyer, maybe ask him and see what he thinks of this little issue.  Maybe it's just one lawyer's opinion.  It is his advice for how to avoid allegations of improper transfers, which apparently has happened in the past.

The real lesson is pay however you like, but check the paperwork before YOU mail it.

I don't know how you do your forms, but I am the last person to check it before I take it from the dealer, put it in an envelope, place my check in it, and put a stamp on it. My dealer prepares the paperwork, but he sure as hell doesn't mail it for me.

Bought my first can today, an Osprey 45.  "The wait" will start in a few weeks if I'm lucky when it arrives at my dealer's ... but, my dealer will let me shoot it at his range until the Form 4 clears.   :thumbup1

Six months is what I was told, and I am 1 1/2 months into the wait.
Remember me saying this?  I didn't realize that the 'wait' does not start until the dealer has the item in hand...  I spoke with them this morning, and apparently they had trouble getting the can from AAC, (something to do with a military contract) so the paperwork was not sent in until the beginning of July.  :banghead

Six to nine months is the current estimate, so, 2013.  :(

Like I said, my last one took about a year between delays from AAC, the Form 3 and Form 4.

The first one I bought a few years ago took 2 months. The one I bought a couple of years ago took 6 months. I hate to think how long a wait I am in for on my current one.

Well, I called the other day and found that my stamp has been approved, and that apparently they have a month to get it in the mail after approval which actually happened on the 16th of November.

Add in the holiday, etc, and I will be lucky to get it by the first of December.

FWIW I just got an error letter due to missing the Assignment to Trust page on a Form 4 I submitted in late July.
The reviewer was pretty decent when I talked with him, gave me his email & fax #, and so I just emailed him the correction.

Is this a sign of being close to the end of the process finally?  I had expected February to March based on what the wait times seemed to be last summer...

...And six months it was.  Dealer called to tell me the paperwork came in.  Too bad it'll be a few weeks before I can get time to go pick it up. :(

Dude, for serious?

It takes about as long as a 4473 and a NICS check to pic it up once the paperwork is back. You can't find 15 minutes to go grab it for a few WEEKS? I know I gotta skip out early sometimes to get to the gun store before they close, but that's just for a shelf check. We're talking about a lunch break here.

Maybe in Italy...

I used a Class III dealer that is almost three hours away.  They are up by Erie, and I am south of Pittsburgh.  I looked extensively for a closer dealer, but was only able to find one - a guy thirty minutes away, who just got his Class III FFL, and told me "we'll learn about [the process] together."  :shocked  NOT someone I want in my corner if there is an issue with the paperwork.

After the paperwork had already been submitted, I was made aware of a dealer about an hour away, as well as my LGS's plans to branch out into NFA items. :dance

ahh. Can't blame you there. It never occurred to me that your dealer would be 3 hours away.

Me either, until I started looking for one.  I used an online 'class 3 dealer locater,' and the majority of the shops that it listed were either out of business, or no longer handled nfa items...  :shrug

I don't wish to cause this thread to drift further, but here is the final update: There is a big show 1 1/2 hrs away on Saturday, and this shop exibits at it.  IF the show is not cancelled due to lack of vendors, I will arange to travel there to complete the transaction.

If I do, I will show pics in another thread.

Yes, it was a sign of the process finishing up.  The Form 4 cleared the other day and I picked up the can today (dealer's 90 minutes away).  July to now is what, 7 months?

Variable 5 to 7 months for Form 4s in the Southeast US put in late last summer.  Both of mine cleared just a week or two ago, within about 5 days of each other, although they were submitted 6 weeks apart.
